These Terms of Use (“Terms”) govern access to and use of the website located at dataflux.life (the “Site”) operated by DataFlux Inc. (“DataFlux,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About DataFlux
DataFlux Inc. is a British Columbia corporation with registered office at 1955 Alpha Way, Suite 120, Burnaby, BC V5C 0K6, Canada (BN 865317492BC0001). We operate a real-time AI data pipeline platform and provide related programmes and professional services. The Site is an informational and contact channel; separate written agreements govern paid services.
2. Eligibility
You must be at least eighteen years of age and capable of forming a binding contract to use the Site. If you use the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Permitted use
You may use the Site for lawful purposes consistent with these Terms, including learning about our pipeline platform, reviewing programme descriptions, and submitting contact enquiries. You agree not to:
- Use the Site in any manner that violates applicable law or regulation;
- Attempt to gain unauthorised access to our systems, networks, or data;
- Introduce malware, automated scraping bots, or denial-of-service traffic;
- Interfere with the Site’s operation or other users’ access;
- Misrepresent your identity or affiliation when submitting forms;
- Harvest personal information from the Site without consent;
- Reproduce, redistribute, or create derivative works from Site content except as permitted by law or with our prior written consent.
4. Intellectual property
All content on the Site — including text, graphics, logos, icons, images, software, and design — is owned by DataFlux or its licensors and protected by Canadian and international intellectual property laws. The DataFlux name, flux channel terminology, and programme codes (including DFX-101 through DFX-601) are proprietary identifiers. You receive a limited, non-exclusive, non-transferable licence to view and download Site content for personal, non-commercial reference. No licence is granted to use our trademarks without written permission.
5. Contact forms and submissions
When you submit information through our contact form, you represent that the information is accurate and that you have authority to provide it. You must complete the PIPEDA consent checkbox before submission. We process submissions according to our Privacy Policy. We are not obligated to respond to every submission and reserve the right to decline engagements that fall outside our pipeline-focused practice.
6. No professional advice
Site content is provided for general information only. It does not constitute legal, financial, regulatory, or technical advice tailored to your circumstances. Pipeline architecture, throughput figures, and reliability statistics described on the Site are illustrative. Actual outcomes depend on source quality, schema design, infrastructure choices, and human oversight. Engage us under a formal statement of work before relying on any Site content for production decisions.
7. Third-party links
The Site may link to third-party websites or services, including font providers and hosting infrastructure. We do not control and are not responsible for third-party content, privacy practices, or availability. Your use of third-party resources is at your own risk and subject to their terms.
8. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE SPECIFIC PIPELINE THROUGHPUT, AUTOMATION LEVELS, OR REGULATORY COMPLIANCE BASED ON SITE CONTENT ALONE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATAFLUX AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM SITE USE SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (C$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Indemnification
You agree to indemnify and hold harmless DataFlux from claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Site, or infringement of third-party rights through your conduct.
11. Service engagements
Programmes, professional services, and managed operations are subject to separate contracts that supersede these Terms with respect to deliverables, fees, confidentiality, intellectual property allocation, service levels, and dispute resolution. In the event of conflict between these Terms and a signed service agreement, the service agreement prevails for that engagement.
12. Privacy and cookies
Our collection and use of personal information is described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy. By using the Site, you acknowledge those policies.
13. Modifications
We may revise these Terms at any time by posting an updated version on this page with a new effective date. Material changes will be indicated by updating the “Last reviewed” date. Continued use after changes constitutes acceptance. If you disagree with revised Terms, discontinue use of the Site.
14. Termination
We may suspend or terminate your access to the Site at any time, without notice, for conduct we believe violates these Terms or harms DataFlux or other users. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — shall survive.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in British Columbia for disputes arising from these Terms or Site use, except where prohibited by consumer protection law.
16. General
These Terms constitute the entire agreement between you and DataFlux regarding Site use. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms; we may assign ours in connection with a corporate transaction.
17. Programme and service descriptions
Programme codes (DFX-101 through DFX-601), pricing in Canadian dollars, duration estimates, and service descriptions on the Site are summaries for planning purposes. Final scope, fees, deliverables, and acceptance criteria are defined only in signed statements of work or enrolment agreements. We reserve the right to update programme curricula and service offerings on the Site without prior notice; enrolled clients are governed by the terms in effect at enrolment unless otherwise agreed in writing.
18. Export and sanctions
You represent that you are not located in, under the control of, or a national or resident of any jurisdiction subject to comprehensive trade sanctions, and that you will not use the Site or our services to export technology or data in violation of Canadian export control laws or applicable international sanctions regimes.
19. Accessibility of terms
We publish these Terms in English. If we provide translations for convenience, the English version controls in the event of inconsistency. We welcome feedback on clarity and accessibility of legal content at [email protected].
